How New Brunswick's real property transfer tax works
The rate has been 1% since April 1, 2016 (it was 0.5% before). It is calculated on whichever is higher, the consideration paid or the property's assessed value under the Assessment Act, which matters when you buy below assessment. The tax is collected by Service New Brunswick through your lawyer when the deed is registered. Transfers between spouses and certain family transfers are exempt.
First-time buyers in New Brunswick
New Brunswick has no land transfer tax rebate for first-time buyers. The federal Home Buyers' Amount, Home Buyers' Plan and First Home Savings Account still apply.
Buying a rental property in New Brunswick
For an investment property the real property transfer tax is not deductible against rental income. It is added to your adjusted cost base, recovered partly through capital cost allowance on the building and fully through a smaller capital gain when you sell, as explained in our capital gains on a rental property guide.
